The Politics of War Crimes Prosecution.

Twenty years ago, former Yugoslavian leader Slobodan Miloevi became the first head of state to be accused of war crimes while still in office. Vladimir Putin may face a comparable level of legal accountability as the Ukrainian war approaches its halfway point and proof of Russian atrocities grows. Feisal G. Mohamed points out that the International Criminal Court (ICC) has the law on its side in a recent essay. The invasion itself is a blatant example of the crime under the “superior responsibility” doctrine, which was devised in the years following World War II and holds Putin accountable for any wrongdoing by Russian soldiers, including the deployment of cluster munitions and the death of defenseless civilians.
