The manslaughter charge against Chief Petty Officer Eric Gilmet has been dismissed on grounds of Unlawful Command Influence (UCI). Gilmet and two Marine Raiders, who have a similar UCI hearing scheduled, faced allegations in connection to the death of Rick Anthony Rodriguez. A judge wrote in their Wednesday ruling that a top Marine lawyer’s actions and words towards Gilmet’s attorney meant that he could not receive a fair trial. Gilmet’s two codefendants, MARSOC Gunnery Sgts. Daniel Draher and Joshua Negron face the same charges and their attorneys have filed for a similar dismissal of charges.
